Automated processing of personal data by the Department of Forward Studies, Urban Planning and Mobility

Preliminary information for data subjects pursuant to article 14 of the Act no. 1.165 of 23 December 1993, amended.

Processing data relating to the ‘Management of property descriptions concerning remarkable buildings’ by the Department of Forward Studies, Urban Planning and Mobility

In accordance with the provisions of the Act no. 1.165 of 23 December 1993 on personal data protection, amended, information gathered as part of this processing operation is collected by the State of Monaco (Human Resources and Training Department), which acts as the data controller (referred to as the Government).

In this context, the Government, through the Department of Forward Studies, Urban Planning and Mobility, uses nominative data processing for the purpose of "Management of property descriptions concerning remarkable buildings".

The processing is warranted based on a legitimate interest pursued by the Department of Forward Studies, Urban Planning and Mobility (DPUM). The Sovereign Ordinance no. 4.482 of 13 September 2013, amended, defines certain buildings in the Principality as being 'remarkable buildings’.
The landscape map appended to this Sovereign Ordinance identifies the listed buildings, and articles 21, 22 and 23 define the applicable regulations. In order to better understand the work that might be authorised on these buildings of historic value, it was deemed necessary to provide a description of them and to assess the quality of each on the basis of a number of criteria. In addition to the name of the building, its address, its building identification number (BAT ID) or other information, the historical background is also of particular interest, sometimes including the names of the commissioning party and the architect in cases where they are important figures in the history of the building or the Principality.

The information processed within the framework of data processing functions is intended for use by Government departments and will not be disclosed for commercial or advertising purposes. Furthermore, the Heritage Council is legally entitled to receive the information that is subject to this processing.

This information is kept only for as long as is necessary for the aforementioned purpose, i.e., the lifetime of the building.

The information relating to the identity of the commissioning party and the architect of the building is historical data taken from the archives of the Nouveau Musée National de Monaco and from the studies and documents submitted as part of the study contract 393-2017-003 of 20 December 2017 ‘Assistance in preparing files on the Principality's remarkable buildings’.

Building addresses and coordinates are taken from the Geographic Information System.

In accordance with the legislation that applies in the Principality, each individual affected by such data processing has a right to access their personal data, as well as a right to object to its processing and a right to its amendment.

To exercise these rights or in the event of any questions about the processing of personal data, the relevant person can submit a written request to the following email address: [email protected], or by post to the Direction de la Prospective, de l’Urbanisme et de la Mobilité, 23, Avenue Albert II, BP 609, MC 98000 MONACO, stating the subject of their request and their surname, first name, email address and date of birth.

To ensure that the response remains confidential and that we are replying only to the person whose data is involved, those submitting requests may be asked to provide proof of their identity, in black and white.

Furthermore, if an interest so warrants, the rights of access and opposition to information concerning a deceased person may be exercised, unless otherwise provided by law, by the ascendant, second-degree descendant or surviving spouse of the deceased.

Individuals who have exercised their rights but feel, after contacting the Government, that their rights have not been respected, can submit a complaint to the Data Protection Authority of Monaco (APDP) : www.apdp.mc.
